Resources for the survivor and the accused

When a sexual assault is reported to campus authorities, the welfare of the survivor is paramount. This individual is encouraged to report any/all forms of sexual assault and will be presented with a variety of options and services.

The Safe Campus staff provides confidential survivor advocacy, support, and referrals to campus and community resources.  Advocates are with survivors as needed and may assist with housing, academic matters, or judicial processes. Services are confidential and free of charge.

The Victim Witness Advocate provides information and support for survivors of rape as the case is prosecuted through the court system.  The office is affiliated with the District Attorney's Office.  The Victim Witness Advocate helps to explain the survivor's rights, the court process, as well as updated information in regard to a survivor's case.  The level of confidentiality is high, in that information is not shared with another agency without consent.

Rape Response provides 24-hour confidential crisis hotline and referral for survivors of sexual assault, their friends and family, or anyone who has questions/concerns related to sexual assault.  They also provide advocates who are available to a survivor as needed such as through medical procedures or court processes. Advocates must complete a 45-hour training program for responding to sexual assault.  They provide support immediately after an incident occurs or whenever the effects are felt.  Support groups are also available.  Survivors may retain total anonymity when using these services if desired. These services are available free of charge


Medical

Immediate medical care is strongly encouraged and is important for the survivor's well-being and for the documentation and collection of physical evidence. Transportation may be arranged to a local hospital for medical care and/or collection of evidence kit. Physical evidence should be collected as soon as possible (within 72 hours) after an incident of sexual assault.  To assure the best chances for successful prosecution, if chosen by the survivor, the survivor is advised not to wash, douche, brush teeth, use the bathroom or change clothes (if possible) prior to going to the hospital.

Student Health Services provides confidential emergency and ongoing medical care including STD and pregnancy testing and emergency contraception.  They may provide preventive medications for sexually transmitted infections and pregnancy. Student Health Services staff may also arrange for transportation to and consultation at St. Joseph's Hospital or Eastern Maine Medical Center.  Certain staff members at Student Health Services are specifically trained to respond to the report of sexual assault, but they do not collect evidence.  They also provide referral/advice regarding campus and community resources.  It is the policy of the University of Maine that health care services and assessments (exam and all necessary laboratory tests) provided by Student Health Services for students alleging sexual assault are provided for the survivor at no charge. 


Legal/Judicial

Any survivor of sexual assault is encouraged to immediately contact the Department of Public Safety. In addition to investigating the alleged crime, Public Safety will assist the survivor in getting any necessary medical attention. Every effort will be taken to protect the rights of the survivor, including soliciting the survivor's input into the course of the investigation. If a sexual assault offense is reported to any University Official other than Public Safety, the survivor should be informed of his or her option to notify proper law enforcement authorities and may be assisted in doing so if requested.

Public Safety is a sworn law enforcement agency and provides emergency response, transportation to medical resources, criminal investigation, liaison with district attorney's office, and referral/advice regarding University and community resources.  They typically assign a female officer to a female survivor in cases involving sexual assault.

If the survivor desires criminal prosecution through the courts, the matter should be reported to the police in the jurisdiction where the sexual assault occurred. The County District Attorney's Office determines if the case will be prosecuted, depending on the evidence.  A Victim Witness Advocate from the County District Attorney's Office helps survivors of sexual assault move through the prosecution process.  Public Safety is helpful in exploring this option

Judicial Affairs provides adjudication of violations of the Student Conduct Code, including sexual assault offenses.  If the accused is a student at The University of Maine and the survivor would like the University to take formal action against the accused, then the incident should be reported to the Director of Judicial Affairs. Student Legal Services is a professional law office retained by Student Government. Legal advice and/or representation are provided to undergraduate students who have paid an activity fee. Student Legal Services cannot advise or handle cases involving disputes between undergraduate students. They can provide a list of referrals to other law offices

The Lawyer Referral & Information Service was established by the Maine State Bar Association to assist the substantial segment of the public who has difficulty in locating a lawyer to provide legal services. The Lawyer Referral and Information Service does not offer legal advice or provide free legal services.

The Director of Equal Opportunity is responsible for monitoring the University's response to cases of sexual assault to ensure that the campus complies with University policy, as well as Maine and Federal laws and guidelines.  When a student has been accused of sexual assault, the Office of Judicial Affairs handles the case.  When a faculty member or other employee is accused of sexual assault, harassment or exploitation, OEO investigates the matter and makes a recommendation to the appropriate administrator. 

Individuals who believe they have been survivors of sexual assault and who do not want to take formal action may discuss the matter with the Director of Equal Opportunity who will explore possibilities for informal intervention and maintain confidential records.  However, the Office of Equal Opportunity cannot promise confidentiality for incidents of sexual assault involving physical assault or where the health and safety of any member of the University community has been or could be endangered.

Hours during the academic session are Mon-Fri, 8am-5pm, with 24-hour emergency phone consultation available by contacting Public Safety at 581-4040 or 911.  Individual counseling services are provided on-campus, free of charge, to all students registered for 6 or more credits.  Students with fewer than 6 credits are eligible for crisis consultation, assessment and referral, group counseling and psychotherapy, and prevention and educational services.  All Counseling Center services and records are confidential in accordance with Maine State Law.

Residence Life Staff - Resident Assistants (RA), Resident Directors (RD) and Village Coordinators (VC) available in the residence halls. Residence Life Staff provide immediate support and response, arrange necessary emergency services, offer advice regarding University and community resources, and intervene to increase safety. Any survivor of sexual assault has the right to request a change in living area. If an immediate threat is felt by a person, the student may be reassigned a room/space on a temporary basis until such time the threat is removed or eliminated.
